Refund Policy

1. Overview

This Refund Policy describes the limited circumstances under which LLC Publishers ("we," "us," "our," or "Company") may provide refunds for our newspaper publication and state filing services.

By engaging our services, you acknowledge and agree to this Refund Policy in its entirety.

2. General No-Refund Policy

ALL FEES ARE NON-REFUNDABLE EXCEPT AS SPECIFICALLY PROVIDED BELOW.

Once payment is received and we begin work on your order, you acknowledge that:

• We immediately incur costs and begin coordinating with newspapers and government agencies
• Our services involve third-party commitments that cannot be easily reversed
• Processing, setup, and coordination costs are incurred regardless of completion
• Refunds would create operational and financial hardship for our business

3. Limited Money-Back Guarantee

What We Promise: We offer a limited money-back guarantee if we are completely unable to secure newspaper publication in approved newspapers for your county.

What This Means: If, despite our reasonable efforts, we cannot arrange publication in County Clerk-designated newspapers in your required county, you will receive a full refund of fees paid to us (excluding any third-party costs already incurred).

Conditions for Refund:

• We must be completely unable to secure newspaper publication in your required county
• The inability must be due to factors within our reasonable control (not external factors such as newspaper closures, strikes, or force majeure events)
• You must have provided accurate and complete information
• You must have cooperated with all reasonable requests for information
• Your LLC must be validly formed and eligible for publication
• No third-party costs have been incurred on your behalf (if costs were incurred, refund will be reduced by those amounts)

Important: This guarantee covers our service only. Once we begin work with newspapers and incur third-party costs, those costs are non-refundable. Our liability for refunds is limited to fees paid directly to us, not total costs incurred.

4. Circumstances NOT Eligible for Refund

NO REFUND will be provided in the following circumstances:

• Delays in service completion due to newspaper schedules or government processing
• Changes in newspaper rates, government fees, or third-party costs
• Your failure to respond to requests for information or clarification
• Inaccurate or incomplete information provided by you
• Changes in your business needs or requirements after service engagement
• Dissatisfaction with service timelines or communication
• Government rejection or request for additional documentation
• Changes in New York State laws or requirements
• Your LLC becoming ineligible for publication after service begins
• Force majeure events or circumstances beyond our control
• Suspected fraud or unauthorized orders (services will be cancelled without refund)
• Partial completion of services
• Any work performed or costs incurred on your behalf
• Change of mind or buyer's remorse
• Economic hardship or inability to pay additional costs

5. Partial Refunds

We do not provide partial refunds under any circumstances. Services are priced as a complete package, and partial completion does not entitle you to any refund.

6. Third-Party Costs

Any costs paid to third parties (newspapers, government agencies, service providers) on your behalf are non-refundable even if we provide a refund for our service fees. These costs include but are not limited to:

• Newspaper publication fees
• Government filing fees
• Processing and administrative charges
• Payment processing fees
• Any other third-party expenses incurred

7. Refund Request Process

If you believe you qualify for a refund under our limited guarantee:

• Submit a written request to support@llcpublishers.com within 30 days
• Provide detailed explanation of why you believe a refund is warranted
• Include all relevant documentation and correspondence
• Allow up to 30 business days for review and response

We will review requests in our sole discretion and make final determinations based on the terms of this policy.

8. Refund Method and Timing

If a refund is approved:

• Refunds will be processed to the original payment method only
• Processing may take 7-14 business days depending on your financial institution
• We are not responsible for delays by payment processors or banks
• Refund amounts may be reduced by processing fees and third-party costs
• We reserve the right to request return of any documents or materials provided

9. Chargebacks and Disputes

INITIATING A CHARGEBACK OR PAYMENT DISPUTE WITHOUT FIRST FOLLOWING OUR REFUND REQUEST PROCESS IS A BREACH OF THESE TERMS.

If you initiate a chargeback or payment dispute:

• We will vigorously contest any unauthorized chargebacks
• You may be responsible for our costs and legal fees
• We may terminate services immediately without refund
• We may report fraudulent chargebacks to appropriate authorities
• You waive any right to dispute legitimate charges for services rendered

10. Service Modification

We reserve the right to modify our services, pricing, or policies at any time. Changes do not entitle existing clients to refunds. If we discontinue services, we will make reasonable efforts to complete orders in progress but are not obligated to provide refunds for work not yet performed.

11. Limitation of Remedies

A REFUND, IF PROVIDED, IS YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH OUR SERVICES.

You waive any right to additional damages, compensation, or other remedies beyond a refund of fees paid to us (excluding third-party costs).

12. Legal Compliance

This refund policy complies with applicable consumer protection laws while protecting our legitimate business interests. Where consumer protection laws provide additional rights, those rights are not waived except to the extent permitted by law.

13. Policy Changes

We may modify this Refund Policy at any time without notice. Changes become effective immediately upon posting. Orders placed after changes are subject to the revised policy.

14. Integration with Terms of Service

This Refund Policy is part of and incorporated into our Terms of Service. In case of conflict, the most restrictive terms apply. All limitations of liability, disclaimers, and dispute resolution provisions in our Terms of Service apply to refund-related matters.
