Under NY LLC Law §203, your LLC is organized in the county you designate in your Articles of Organization. Under §206, publication runs in that designated county. You choose the county. We file the paperwork.

Every New York LLC must designate a county of organization when forming. This is a statutory requirement, not an administrative preference.
NY LLC Law §203(e)(2)
Section 203(e)(2) requires the Articles of Organization to state "the county within this state in which the office of the limited liability company is to be located."
What this means
Every New York LLC has a designated county on record with the NY Department of State. That county can be any of the 62 counties in New York, chosen by the person forming the LLC. The designation is made in the Articles of Organization and can be updated later by filing a Certificate of Change (DOS-1359-f).
Publication Runs in the Designated County
NY LLC Law §206 ties publication directly to the county listed in your Articles of Organization. Newspapers are designated by the clerk of that county, and the notice runs there.

Section 206 requires a notice to be published "in two newspapers of the county in which the office of the limited liability company is located, as designated by the clerk of that county."
What this means
The county on record controls where publication happens and which newspapers are designated. When the designated county changes, publication moves with it. The clerk of the newly designated county assigns the newspapers for that notice.
NY Does Not Require Proof of Address for the County Designation
Section 206(a)(3-a) lists the items a published notice may contain. The statute phrases several of them with the qualifier "if any."

The section lists items such as the principal business location "if any" — language that reflects the fact that an LLC may or may not have such an address.
What this means
NY DOS does not require proof of a physical address in the designated county. The county is a statutory designation, not an address verification. This is a feature of the statute, not a workaround.
The customer designates the county. LLC Publishers does not recommend one.
Once Publication Is Complete, You Stay
The designation is forward-looking. After publication is filed, there is no statutory requirement to republish if you later change any of the items that appeared in the notice.

Your LLC remains in the designated county going forward. The publication requirement is satisfied once. You do not need to republish in the future.

How County Changes Get Filed
Updating your county of organization means filing a Certificate of Change (DOS-1359-f) with the NY Department of State. There are three common ways this happens.

Can an LLC change its county of organization?
Yes. NY LLC Law §211-A authorizes a Certificate of Change (DOS-1359-f), filed with the NY Department of State, to update specific items in an LLC's Articles of Organization — including the LLC's designated county (the "location of the office"). The state filing fee is $30.
Does the 120-day deadline apply to the county change?

Will my LLC stay in the new county permanently?

The county designation under §203 is separate from service-of-process arrangements. §206 requires publication in the designated county; it does not require a physical presence there. Many NY LLCs operate with the Secretary of State as the designated agent for service of process.

The county of organization is the statutory county designation in your Articles of Organization. It is distinct from the mailing address you provide to DOS for service of process, your physical business location, and where you operate.

Newspaper rates differ across New York's 62 counties. §206 requires publication in a daily and a weekly newspaper designated by the county clerk. The newspapers in each county set their own rates, which is why totals vary by county.
What if I'm past the 120-day deadline?
§206 allows publication to be completed after 120 days; the statute describes a suspension of the LLC's authority to carry on business until publication is complete.
