Why Does County Matter?

Publication County = Your LLC's County Designation

You must publish in the county listed in your Articles of Organization. This is a designation in your formation documents filed with NY DOS—not necessarily where you live or operate.

Newspaper Rates Vary Dramatically

NYC borough newspapers charge 2-3x more than upstate papers for the same legal notice. Manhattan publication can cost over $1,000 more than Albany.

County Clerk Designates Approved Papers

Each county clerk maintains a list of newspapers approved for legal notices. You must use papers from this list—we verify current designations for every order.

In an Expensive County? Save with County Change

If you're in an NYC borough or other high-cost county, you can legally change your county designation to Albany before publishing—saving hundreds. Learn how County Change works →

Frequently Asked Questions

Common questions about NY LLC publication and county requirements

How do I know which county I need to publish in?
Your publication county is determined by the county designation in your Articles of Organization—the document you filed to form your LLC with the NY Department of State. Look for the county field on your formation documents. This is NOT necessarily where you live or operate; it's a filing designation you chose (or your formation service chose) when creating the LLC.
Can I publish in a different county than where my LLC is designated?
No, you must publish in the county designated in your Articles of Organization. However, you CAN change your county designation by filing a Certificate of Change (DOS-1359-f) with NY DOS before publishing. This is called "County Change" and can save you hundreds of dollars if you're in an expensive county like Manhattan or Brooklyn. We offer this as a service.
Why do publication costs vary so much between counties?
Publication costs are driven by newspaper advertising rates, which vary dramatically across New York. NYC borough newspapers (Manhattan, Brooklyn, Queens, Bronx, Staten Island) charge premium rates for legal notices—often 2-3x more than upstate papers. Albany County has some of the lowest newspaper rates in the state, which is why County Change to Albany is so popular.
What if my county isn't listed with a dedicated page?
We serve all 62 New York counties. Counties without dedicated pages are covered under our "Other NY Counties" pricing. The process is identical—we handle newspaper selection, publication coordination, affidavit collection, and state filing for every county in New York.
What does "all-inclusive" pricing mean?
Our prices include everything needed to complete your publication requirement: publication in two designated newspapers for six consecutive weeks, collection of notarized affidavits from both newspapers, preparation and filing of your Certificate of Publication with NY DOS, and the $50 state filing fee. There are no hidden costs or surprise fees.
What is the 120-day deadline?
New York LLC Law Section 206 requires LLCs to complete the publication requirement within 120 days of formation. If you miss this deadline, your LLC's authority to conduct business in New York may be suspended. We track deadlines for all our customers and prioritize orders approaching their deadline.
How long does the publication process take?
The publication process takes approximately 8-10 weeks from start to finish. This includes 6 weeks of consecutive publication in both newspapers (required by law), plus time for newspapers to prepare notarized affidavits and for us to file with the state. We begin the process within 1-2 business days of receiving your order.
What happens if you can't complete my publication?
We guarantee delivery of your Certificate of Publication or a full refund of our service fee. To deliver on this guarantee, we require accurate LLC information and timely responses from you. We have successfully completed every publication for customers who provided valid LLC formation documents and responded to required requests.
