Your NY LLC publication notice must include six elements: LLC name, filing date, county, SSNY agent designation, mailing address, and business purpose — all matching your Department of State records exactly. This is required by Section 206 of the NY LLC Law. Getting any element wrong — or using a non-designated newspaper — means the publication doesn't count and you'll need to start over.

Match State Records Exactly
This is the most important rule: your notice must match your NY Department of State records exactly. This includes:
- LLC name — even if it has a typo in the state records
- Filing date — the exact date on your filed Articles of Organization
- County — as listed in your Articles
- Service address — as recorded with the state
If your LLC name was filed as "ACME HOLDING LLC" (missing the S), your notice must say "ACME HOLDING LLC" — not the corrected version. Newspapers and the state cross-reference your notice against official records.
Which Address to Use
Three different addresses are involved in LLC formation, and they're often different. This confuses many filers.
Service of Process (SOP) Address
This is the address you must use in your publication notice. When you filed your Articles of Organization, you designated the Secretary of State of New York (SSNY) as your agent for service of process and provided an address where SSNY should forward legal documents. That's your SOP address.
Registered Agent Address
If you use a registered agent service, their address may be listed as your SOP address. In that case, use the registered agent's address.
Principal Business Address
Some newspapers use "principal business address" in their template. This is a formatting variation — you should still use your SOP address as recorded with the state.
The rule: Always use whatever address is recorded as your Service of Process address with the NY Department of State.

Three Format Options
All three formats contain the same legally required information. They differ in length, which affects your publication cost since many newspapers charge by the line.

Format and Cost

Never Abbreviate
- Your LLC name — always use the exact legal name
- City names — beyond standard postal abbreviations
- SSNY designation language — the phrase about SSNY being designated as agent is legally required
When in doubt, use the Standard or Compact format. The savings from Ultra-Compact are typically small, but a rejection costs time and re-publication fees.
Common Rejection Reasons
These mistakes cause rejections and delays. All of them are preventable.

Wrong address. Using your home or business address instead of the Service of Process address recorded with the Department of State.

Can I use 'any lawful purpose' for the purpose clause?
Yes. "Any lawful purpose" is the standard and most common purpose clause. Unless your LLC has a specific stated purpose in its Articles of Organization, use "any lawful purpose."
Does my notice need to be in English?
Yes. New York law requires publication notices to be in English. The designated newspapers publish legal notices in English.
Can I publish the full Articles of Organization instead of a short notice?
Yes. Section 206 allows you to publish either the full Articles or a short notice containing the six required elements. The short notice is far more common because it costs significantly less.
What if my LLC name has a typo in the state records?
Publish using the name exactly as it appears in the state records, typo included. Then file a Certificate of Amendment to correct the name. Publishing with a "corrected" name that doesn't match state records will result in rejection.
Do I need to include my EIN in the notice?
No. Your EIN is not one of the six required elements. Do not include it in your publication notice.
Can I publish before my Articles of Organization are officially filed?
No. You need the official filing date from the Department of State before you can publish. The filing date is a required element of the notice.
Is the notice different for foreign LLCs?
Yes. Foreign LLCs publish a "Notice of Qualification" instead of a "Notice of Formation." The notice must include additional information: home state jurisdiction, original formation date, and home state office address. This makes the notice longer and results in higher newspaper costs.
Is the notice different for PLLCs (Professional LLCs)?
Slightly. PLLCs must use "professional service limited liability company" instead of "limited liability company" in the notice. Otherwise, the required elements are the same. PLLCs also use a different DOS form (DOS-1709 instead of DOS-1708) when filing the Certificate of Publication.
